This document contains important information about Makerspace Delft, and the rules and expectations of our community members. It is also a thrilling read, so settle in, and thanks for taking the time!

Introduction

Makerspace Delft manages and operates a workshop at Schieweg 15D, Hal X2, in Delft. Its legal name is Stichting Makerspace Delft, and is registered as a 'Stichting' under the chamber of commerce (80796451), hereafter referred to as 'the Makerspace', 'we', or 'us'.

The authorized staff of the Makerspace will hereafter be referred to as 'staff'.

All community members who have an active subscription at the Makerspace will hereafter be referred to as 'Members' or 'you'.

You understand that by becoming a member of the Makerspace, you agree to these terms and conditions. Not agreeing to or following the terms and conditions set below, may result in your expulsion as a member of the Makerspace.

T&C AMENDMENTS All changes to these Terms & Conditions will be communicated to the members of the Makerspace via the general channel on Discord.

Standard Liability Waiver

Any use of the Makerspace, including any use of machinery and equipment, is at your own risk. You must read all signs and follow all directions given by the staff. You acknowledge the risk warning set out below.

We exclude all liability to you to the maximum extent permitted by law, including for negligence and whether the loss or damage has occurred to person or property. Where that liability cannot be excluded, we limit our liability to you to the maximum extent permitted by law. To the extent permitted by law, we exclude all liability to you for: death; physical or mental injury (including the aggravation; acceleration or recurrence of an injury); the contraction, aggravation or acceleration of a disease; the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual that: is or may be harmful or disadvantageous to the individual or community; or may result in harm or disadvantage to the individual or community. We are not responsible for: any damage, loss or theft incurred to personal property and/or equipment that you bring into the Makerspace, or generate/create in any area of the Makerspace.

RISK WARNING THERE ARE RISKS ASSOCIATED WITH USE OF THE SPACE AND PARTICULARLY USE OF EQUIPMENT AND MACHINERY. THIS INCLUDES RISK OF PHYSICAL HARM OR PERSONAL INJURY INCLUDING PERMANENT DISABILITY AND/OR DEATH. ANY SUCH INJURY CAN RESULT NOT ONLY FROM YOUR ACTIONS BUT FROM THE ACTION, OMISSION OR NEGLIGENCE OF OTHERS.

General

ENTERING THE MAKERSPACE Members may only access the Makerspace if they valid proof of membership at the entrance gate. Also be sure to say hello and make yourself known to the staff on duty when you arrive. Accessing the Makerspace without a valid proof of membership will deem you a trespasser and after two warnings will result in a 1 week suspension of your membership.

ALCOHOL & DRUGS Members may only access the Makerspace if they are not under the influence of alcohol or drugs and must not bring alcohol or drugs into the space under any circumstance. Breaching this requirement will result in the suspension and eventual cancellation of your membership. Alcohol may only be consumed in the Makerspace as part of an event or if approved by the staff (for example if you have finished all your work). A two drink maximum applies.

CLEANLINESS Members are required to clean up after themselves. This involves cleaning up the machinery and equipment after using it, and placing them back into their correct locations. Furthermore, any residue must also be cleaned up. Any used cutlery or dishware must also be cleaned by the member.

SAFETY TRAINING All members are required to pass the mandatory safety training provided by authorised staff. This also includes reviewing the safety guidelines Safety. The training is held during your first visit to the Makerspace and lasts no longer than 90 minutes. Attempting to use equipment or tools without completing the safety training may result in the termination of your membership. Staff may require you to complete a second safety training if they deem your attention to be unsatisfactory during the first safety training.

SAFETY EQUIPMENT All members are required to wear the appropriate safety equipment as specified in the equipment use procedures.

TECHNICAL TRAINING The following list of equipment and machinery require training before using: Lasercutter; 3D printer; Bandsaw; Drillpress; Soldering Station; Pottery corner. INTELLECTUAL PROPERTY The Makerspace may not claim any right to any intellectual property brought in or developed by the members. The Makerspace does not claim any liability to other members potentially claiming rights to other members intellectual property.
